本利用規約（以下、「本規約」といいます）は、「クラシックギター研究室」（以下、「当サイト」といいます）が提供するアプリケーション「Pulsar Tuner」（以下、「本アプリ」といいます）の利用条件を定めるものです。本アプリを利用するすべてのユーザー（以下、「ユーザー」といいます）は、本規約に同意したものとみなされます。
第1条（権利帰属）
本アプリを構成する文章、画像、プログラム、デザイン、音源その他一切のコンテンツに関する著作権その他の知的財産権は、当サイトまたは正当な権利を有する第三者に帰属します。
第2条（禁止事項）
ユーザーは、本アプリの利用にあたり、以下の行為を行ってはなりません。
- 本アプリのプログラムをリバースエンジニアリング、逆コンパイル、逆アセンブル、または改変する行為。
- 本アプリの動作を妨害する行為、またはサーバー・ネットワークに過度な負荷をかける行為。
- 当サイトまたは第三者の権利を侵害する行為、その他法令や公序良俗に反する行為。
第3条（広告の配信）
本アプリでは、無料でのサービス提供を維持するため、Google AdMob をはじめとする第三者配信事業者による広告を表示します。広告の取り扱いについては、別途定めるプライバシーポリシーに従うものとします。
第4条（免責事項）
- 当サイトは、本アプリのピッチ検出精度、動作の正確性、有用性、特定の目的への適合性について、いかなる保証も行いません。
- 周囲の騒音環境、マイク性能、演奏環境等により、正確なピッチ判定が行われない場合があります。
- 本アプリのチューニング指示に従った結果生じた弦切れ、楽器本体や関連機材の破損・故障、調律の狂い、その他一切の不利益や損害について、当サイトは責任を負いかねます。チューニング時のペグの巻き上げ等は、ユーザー自身の自己責任において行ってください。
- 本アプリからリンクされている外部サイト（当サイトのウェブ記事や姉妹アプリのストアページ等）の内容について、当サイトは一切の責任を負いません。
第5条（サービスの変更・停止・終了）
当サイトは、ユーザーへの事前の通知なく、本アプリの仕様変更、機能の追加・削除、または提供を一時停止・終了することができるものとします。これによってユーザーに生じた損害について、当サイトは一切の責任を負いません。
第6条（規約の変更）
当サイトは、必要と判断した場合には、ユーザーへの事前の通知なくいつでも本規約を変更することができるものとします。変更後の規約は、本アプリ内または当サイト上に掲示した時点から効力を生じるものとします。
第7条（準拠法・裁判管轄）
本規約の解釈にあたっては、日本法を準拠法とします。本アプリに関して生じた紛争については、当サイトの運営所在地を管轄する裁判所を専属的合意管轄とします。
These Terms of Service (hereinafter referred to as the “Terms”) define the conditions for using the application “Pulsar Tuner” (hereinafter referred to as the “App”) provided by “Classical Guitar Lab” (hereinafter referred to as “we” or “our”). By using the App, all users (hereinafter referred to as “Users”) are deemed to have agreed to these Terms.
Article 1 (Intellectual Property Rights)
All intellectual property rights, including copyrights in texts, graphics, code, designs, sound sources, and other materials constituting the App, belong to us or legitimate third-party rights holders.
Article 2 (Prohibited Actions)
Users shall not engage in any of the following actions when using the App:
- Reverse engineering, decompiling, disassembling, or altering the App’s software.
- Disrupting the operation of the App or imposing an excessive load on related networks.
- Infringing upon our rights or those of third parties, or violating applicable laws and public order.
Article 3 (Advertisements)
To keep the App free to use, advertisements provided by third-party ad networks, including Google AdMob, may be displayed within the App. Handling of ad data is governed by our Privacy Policy.
Article 4 (Disclaimer of Warranty and Limitation of Liability)
- We make no warranties regarding the accuracy of pitch detection, performance, reliability, or fitness for a particular purpose of the App.
- Accurate pitch detection may be affected by ambient background noise, microphone limitations, or acoustic environments.
- We assume no liability whatsoever for broken strings, damage or malfunctions to instruments/equipment, or any other loss resulting from tuning with the App. Tuning peg adjustments and instrument handling are performed at the User’s sole discretion and risk.
- We assume no responsibility for the contents of third-party websites linked within the App (such as external blog articles or store pages).
Article 5 (Modification and Termination of Service)
We reserve the right to modify, add, suspend, or discontinue the App or any of its features at any time without prior notice. We shall not be liable for any damages or inconveniences arising from such changes.
Article 6 (Changes to the Terms)
We reserve the right to modify these Terms at any time without prior notice. The updated Terms shall become effective immediately upon being posted within the App or on our website.
Article 7 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising in connection with the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location.
